These are granted. on application to the Court, to the person hom the Court appoints to settle the lirs of a deceased person in accordance vith that person’s proven will or on his intestacy. The provisions of the law regarding the duties of the testator to provide for certain classes of dependants and the rules applicable on an intestacy must be observed. They are only granted when no executor has been appointed or when an appointed executor is unable or refuses to act, or is debarred from acting.
