A married woman has an implied authority to pledge her husband’s credit for necessaries. He can only escape liability by showing that he has forbidden his wife to do so and has given notice to those persons whose bills he has paid in the past. If the husband had already supplied the wife with sufficient goods, then naturally she cannot claim the goods purchased to be ‘necessaries’.
